Fresenius Kabi USA, LLC (“Fresenius Kabi USA,” “Us” or “We”) is a global healthcare company that specializes in lifesaving medicines and technologies for infusion, transfusion, and clinical nutrition. Our products and services are used to help care for critically and chronically ill patients. To carry out our work we may need to collect, use, and sometimes share your Personal Information. This Privacy Notice explains how and why we collect, use, and share your Personal Information, as well as your related privacy rights and how to exercise them.
The Scope of this Notice
This notice applies to Fresenius Kabi USA’s websites, social media pages, mobile platforms, direct marketing activities as well as when you participate in clinical studies, programs or services we offer, or have other business interactions with us that we reference in this Privacy Notice, collectively referred to as “Websites and Services.”
The term "Personal Information" as used throughout this Privacy Notice applies to any information that is used by or on behalf of Fresenius Kabi USA that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual.

Fresenius Kabi USA may collect, use or otherwise process your Personal Information when you:

The type of Personal Information that Fresenius Kabi USA collects will vary depending upon the context of your relationship with Us. The categories of Personal Information collected may include:
- Personal or professional contact information (e.g., name, email address, phone number, practice location, organization)
- Employment information and professional experience
- Demographic information, including your gender, age or date of birth
- Information collected through tracking technologies, including IP address and other online identifiers
- Recordings: for data requests or customer service purposes
- Inferences drawn from other Personal Data such as social media profiles or other public records or websites.
How We Use Your Personal Information
We use, or otherwise process your Personal Information to:
- Recruit for employment purposes
- Respond to questions on recruitment to our clinical trials or refer you to specific organizations that may provide information on how to participate in clinical trials or to facilitate clinical trials
- Address questions related to products in development, or in market
- Deliver requested information on resources available related to the therapeutic areas or other medical or scientific areas that We provide
- Develop new products and services
- Operate, evaluate, secure, and improve our Websites and Services, to analyze use of our Websites and Services, or to enhance or develop new features for our Websites and Services
- Provide marketing information or to send you marketing communications about the wide array of Fresenius Kabi USA products and related Services ranging from injectable drugs to transfusion medicine, cell therapy, infusion, and clinical nutrition technologies and across various therapies and treatment options
- Measure the effectiveness of our advertisements and to control and limit the frequency of advertisements and other information being displayed to you
- Invite you to participate in our events
- Conduct surveys, or polls and/or obtain testimonials
- Staff, facilitate, and manage market research, studies, and related activities
- Create aggregated analytics for research purposes
- Provide support-related activities, such as customer service
- Effect legally‐mandated reporting and retention requirements
- Fulfill our obligations to you under an applicable contract or to conduct business with you
- Protect against, identify, investigate and respond to fraudulent, harmful, unauthorized, unethical or illegal activity
- Comply with regulatory monitoring and reporting obligations, such as those related to adverse events, product complaints, spend transparency, and patient safety
- Conduct other legitimate business activities, as allowed by applicable law
We may combine the Personal Information we collect about you online with the Personal Information we collect about you from our offline interactions with you (for example, our interactions by telephone or in person). We may also combine any of the information we collect about you with information we lawfully obtain from other sources, such as public records or websites, or other third parties (e.g., health care professionals, patient groups, government agencies). When required, we will request your consent, or provide you with an opportunity to opt- out of this type of processing of your Personal Information.
Processing of Sensitive Information
In course of offering our Websites and Services we may also collect and process Personal Information that is of a sensitive nature, including information that may under certain laws be defined as Consumer Health Data. Examples of Sensitive Information include:
- Username and password that you may select in connection with establishing an account on our Websites
- Precise geolocation
- Disciplinary actions and/or criminal proceedings and/or sanctions
- Identification information, such as identity cards, passport, visa, social security number or other taxpayer/government identification number like driving license details
- Financial information, such as your bank account number for employment credit checks
- Information related to your health and medical condition(s), which may include genetic data or biometric information, medical treatments, medications, test results; and/or information about your insurance.
We may use this Sensitive Information, as necessary, to:
- Facilitate recruitment, evaluate candidates for employment purposes and conduct employee-related activities, such as payroll and benefits
- Provide and manage clinical research opportunities, patient support programs and other Services we offer
- Access and manage accounts you create with us, such as your ordering profile or to manage your access to your job candidate profile
- Process and manage safety and quality concerns
- Conduct other legitimate business activities, as allowed by applicable law.
We will only process Sensitive Personal Information and Consumer Health Data when we have your express consent, or as required or permitted under applicable law, for example, when necessary to comply with applicable law, respond to legitimate requests from government authorities, including authorities that may be outside of your country of residence, to protect or defend our legal interests, and if necessary to protect the safety of our employees and other stakeholders. You may request to opt-out of or limit the processing of your Sensitive Personal Information or Consumer Health Data by clicking the link “Limit The Use of My Sensitive Personal Information” on our Websites or contacting us using the details found in the “Contact Us” section of this Notice.

Cookies and Similar Technologies
We use cookies and similar technologies (such as web beacons, tags, scripts and device identifiers) to collect and store analytics and other information when you use our Websites and Services. The cookies we use include both first party and third-party cookies.

How and With Whom We Share Your Information
We may disclose your Personal Information with the following:
- Our vendors: We share your information with vendors that provide services on our behalf, such as payment processors, enterprise software providers, customer service, audit and accounting firms, security vendors, marketing and events services, and physical or electronic information storage services. We authorize vendors to use or disclose Personal Information only as necessary to perform services on our behalf or comply with legal requirements. We require our vendors to contractually commit to protect the security and confidentiality of data they process on our behalf.
- Other Fresenius Group companies: We share Personal Information with other Fresenius entities to provide our Services and other products and services as well as for internal administrative purposes.
- Unaffiliated strategic partners: We may share Personal Information with other select unaffiliated entities to carry out joint development, marketing, or management of our products or services.
- Advertising partners: We share Personal Information with our advertising agencies in support of our marketing campaigns. We authorize these vendors to use or disclose Personal Information only as necessary to perform services on our behalf or comply with legal requirements.
- Where required or permitted by law or in the context of an audit or other review: We share information with law enforcement agencies, courts, other government authorities or other entities, where we believe it is necessary: (i) to comply with a legal or regulatory obligation; (ii) to protect the rights, safety, and property of Fresenius Kabi USA, you or others; and (iii) to respond to requests from courts, law enforcement agencies, regulatory agencies and other public and government authorities.
- In the context of a transaction: We may share Personal Information in connection with the consideration, negotiation, or completion of a corporate transaction, such as a merger or acquisition, divestiture, consolidation, or a sale or transfer of all or a portion of our assets or business, including during the course of any due diligence process, or in the unlikely event of bankruptcy.
When we share your Personal Information for a business purpose, we enter into a contract with these third parties that describes the purposes for sharing your Personal Information, requires the third-party recipient to protect the confidentiality and secure the Personal Information shared, and prohibits the use or disclosure of the Personal Information except in accordance with this Privacy Notice and for the purpose(s) performing the services under the contract, or as necessary to comply with applicable law.
Retaining Your Personal Information
We will retain your Personal Information for the time-period required or allowed by applicable law. Otherwise, we keep your Personal Information for as long as reasonably necessary to serve the purpose(s) for which it was collected.
International Transfers of Personal Information
Your Personal Information may be stored and processed in any country where we have facilities or in which we engage service providers. We will only transfer your Personal Information where we have established a legal basis and put in place adequate measures to protect your Personal Information as may be required by local law, but you should not use our Websites or Services if you do not want your Personal Information potentially transferred to, or otherwise processed in countries outside of your country of residence, which may have data protection laws that are different from those of your country. In certain circumstances, courts, law enforcement agencies, regulatory agencies or security authorities in those other countries may be entitled to access your Personal Information.
If you are located in the EEA your Personal Information may be transferred to Fresenius Kabi USA and our affiliates, each a data controller, or to service providers in non-EEA countries that are not recognized by the European Commission as providing an adequate level of data protection according to EEA standards. For transfers from the EEA to countries not considered by the European Commission to have adequate protections, we have implemented measures to protect your Personal Information, such as standard contractual clauses adopted by the European Commission. Exercising Your Rights
You may contact us at privacy@fresenius‐kabi.com to request access to the Personal Information we have collected about you, or to update or correct Personal Information that you have provided to us.
You may have the right to request access to, modification, export or deletion of, your Personal Information under law. These rights are not absolute and may only apply in certain circumstances. This means that we may be unable (e.g., due to legal requirements) or not obligated to satisfy your request.
In some cases, we may need to collect additional Personal Information from you to verify your identity before providing you access to or deleting your Personal Information, such as a government-issued identification. Fresenius Kabi USA will not discriminate against you for exercising your rights, but we may not be able to provide you with Services that you have requested if we are not able to use your Personal Information.
If you have provided permission (consent) to Fresenius Kabi USA to process your Personal Information, you have the right to withdraw your consent for such processing at any time by contacting us at privacy@fresenius‐kabi.com. You can click the link “Do Not Sell/Share My Personal Data” on our Websites to opt-out of sharing your Personal Information with any cookie provider that may use your Personal Information for their own purposes or manage this directly via our Privacy Preference Center by opting-out of Performance and Targeting cookies. Please note that if you opt out of receiving promotional or commercial messages from us, this does not impact other transactional and administrative messages which you will continue to receive (such as emails relating to changes to this Privacy Notice).
Security
Fresenius Kabi USA implements commercially reasonable technical, administrative, and physical measures to protect Personal Information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. Please note that while we take steps to secure Personal Information you share with us, the security of your Personal Information cannot be guaranteed. We encourage you to take special care in deciding what information you share with us via email or other Internet transmission.
Children
We are committed to protecting the privacy of children. Our Websites and Services are not directed to children who are under the age of 16 and we do not knowingly collect Personal Information from children under the age of 16. If we learn that we have collected Personal Information directly from a child under the age of 16 through our Websites and Services, we will delete that information. We encourage all parents and guardians to monitor their children’s use of the Internet.

Our Websites and Services may contain links to third-party websites and/or online services. Any access to and use of such third-party websites and/or online services is not governed by this Privacy Notice but is instead governed by the privacy policies of those third-party websites and/or online services. If we do make such changes, we will post an updated version on this page, unless another type of notice is required by the applicable law. Additionally, when required under applicable law, we will request additional consent to collect and process your Personal Information.
